Definitions

Kano Surveys is a product operated by Waypoint Software Pty Ltd (ACN 695 352 295). References in these Terms to "kanosurveys.com", “Kano Surveys”, “we”, “us” or “our” refer to Waypoint Software Pty Ltd as the legal entity providing the Kano Surveys platform and related services.

1. General

1.1 By continuing to use this website (kanosurveys.com), you agree that:

• You use this website at your own risk
• You will not hold the website owners liable for anything, ever
• You will not copy, redistribute, re-sell or re-license any of the content or functionality found on this website
• You have read and agree to the Privacy Policy

2. Premium upgrades (pay-per-survey)

2.1. Premium upgrades are our paid product which unlock various additional features and allowances within the product as described on the Premium page. Premium upgrades are not required in order to make use of the site - you can use the site within the free tier for as long as you like.

2.2. Premium upgrades are purchased per survey. This means the payment applies to the specific survey you choose to upgrade (not your entire account), and you may choose to upgrade some surveys and not others.

2.3. Unless otherwise stated on the Premium page or during checkout, payments for Premium upgrades are one-off payments (not ongoing subscriptions) and will not automatically rebill.

2.4. We use Stripe as our payment partner. By purchasing a Premium upgrade you agree to Stripe processing your payment and related transaction data required to complete the payment.

2.5. Premium upgrades are non-refundable once payment is made, except where required by law. Please ensure you have selected the correct survey and Tier before completing checkout.

2.6. We reserve the right to change Premium upgrade pricing and/or what is included in each Tier from time to time. Any changes will apply going forward and will not affect upgrades already purchased, unless required for security, legal compliance, or to prevent misuse.

3. Legacy Premium subscription (existing subscribers only)

3.1. In the past, we offered Premium as a subscription product with automatic rebilling. This subscription model may still apply to customers who previously started a subscription ("Legacy subscribers") and have not yet reached the end of their paid period.

3.2. New customers cannot start a new subscription under this Legacy subscription model. Current Premium pricing and purchase options are shown on the Premium page.

3.3. All legacy subscriptions have been cancelled. You do not need to do anything. Once cancelled, the subscription will not continue and no further automatic rebilling will occur.

3.4. If you have time remaining in a previously paid period, you may continue to have Premium access until the end of that period. Any new surveys created during that time will be automatically upgraded to the Professional tier. No refunds or credits are available for unused time within a subscription period, except where required by law.

3.5. Once the last paid period ends, access will revert back to the free access levels and limits will re-apply. No data will be lost from your account, and you'll still be able to access the data you've collected up to that point.

3.6. If you are in a free trial period, we will cancel the subscription so that it does not convert into a paid subscription. Any Premium access available during the trial will end when the trial ends, unless you purchase a Premium upgrade under the pay-per-survey model.
